What Happened?

Sadly, on November 10, 2018, Amy Mullis was injured on the family farm and passed away later that day. Without ever conducting a thorough examination of the scene, police immediately, on day one, rushed to judgment and claimed that a murder had occurred. Even though no forensic evidence linked Todd to the death of his wife, and even though there was a witness who confirmed to police that Todd was with him the entire time, making it impossible for him to have killed his wife. Still, the police claimed that it was murder, and chose Todd to be their number one suspect. The Justice For All Institute has been working with Todd in search of justice and his release. After hiring forensic experts and investigators we are confident in his innocence. Learn more about the trial below.

Court of Appeals Hears Oral Arguments

During arguments in front of the Court of Appeals the State admits it’s not impossible for Ms. Mullis’ injuries to have resulted from an accidental fall.

APPELLATE JUDGE:  “How do you respond to Mr. Mullis’s argument regarding the number of puncture wounds in the victims back and whether that could be an accident if she fell once or twice on that particular piece of equipment?”

STATE:  “Is it impossible? Maybe not. But, this is a sufficiency review.”

DAY 3
Due to the aural ambiguity, psychologists suggest that people rely on priming effects to help determine what they are likelier to hear.

Research suggests that we do not hear by analyzing the frequencies of the noises that enter our ears and then determining the words that these frequencies form.

Instead, we utilize what is known as top-down processing. Our brains first recognize some sounds like speech. Then, our brains utilize context cues to interpret the meaning of these speech sounds….

This can help explain why people often misinterpret song lyrics. When the sound is ambiguous, your brain fills in the missing information as best it can. Priming effects can then come into play. If you are primed to interpret a lyric in a particular way, you will be more likely to hear it in a certain way based upon that priming.

The fact that people who heard the [words] were already expecting to hear [them] primed them to hear [] those [] words rather than some other word.

Day 6

Postconviction Relief Trial – Final Day of Testimony

  • Live Testimony: The final day included scheduled live testimony from key witnesses, including the FBI Behavioral Analyst, who provided an equivocal death assessment and behavioral evaluation supporting Todd’s innocence.
  • Additional testimony showed that Todd rendered aid to his wife, and that he immediately instructed the funeral home to delay cremation after being accused—actions inconsistent with guilt.
  • State Reverses Position: Although the State had previously insisted that all witnesses be called live at trial, on the final day, the State reversed course and agreed to allow Todd’s attorney to admit several depositions (prior sworn testimony) in lieu of testifying by live appearance at the PCR Trial. This marked a major shift and streamlined the remainder of the case presentation.
    • See 1/9/2025 Hearing Transcript – Page 98 Lines 20 to Page 99 Line 9.

MS. NICHOLS COOK:  Your Honor, I think we hadattempted to reach out to the State and exchange someemails about whether there were going to be anystipulations to admitting some depositions instead oflive testimony. We have not met, with the holidays andeverything I think is part of the problem, but I think we have always been open to stipulating to admission ofdepositions and reports instead of calling certainwitnesses in order to streamline this and be moreefficient for the Court, but we also are available forthe ten days, if necessary, at this time.

HE COURT: Mr. Bakke or Mr. Duden?

“MR. DUDEN:   Thank you, Your Honor. At thistime we don’t stipulate to anything, and they can calltheir witnesses accordingly. Thank you.”

  • End of Witness Testimony: Following this agreement, live testimony concluded. The State rested without presenting any additional witnesses. Closing arguments followed.
